SUMMARY
- After a long distance relationship of 5 years, Katsumi (Mexican) and I (Jimmy, Belgian) got married in april 2017. We decided to buy a modest house which we knew needed a lot of work to be done, but with much effort, it would become our dream house, the ideal one to start a family.
- The renovation was necessary to comply with regulations in Belgium, it started 3 years ago and it included electrical and plumbing repairs, thermal insulation, asbestos removal, etc.
- Shortly after it started, we got scammed by the contractors, they took our money and left us with more damage than initially needed to be repaired.
- We sued the contractors in 2018. It was the only way we had to legally break the contract, even though they were the ones who had failed to comply.
- We have already gone through the most complicated part of the process, the legal expertise inspection, but we need to cover one last fee to get them to court.
- We have used all of our savings for the lawsuit and we are still paying the bank for the loan that we asked for the renovation and which the contractors stole.
- We are asking for your help to pay the legal fee of 14,000 euros and to repair the most urgent damages that compromise the security of our home and our well-being (see details below "Where are the funds going?")
- Not paying the legal fees would mean taking the risk of losing our house because the government may take possession of it and auction it off to collect what we owe to the ministry of justice.
- Even if we win the case, the chances of the company declaring bankruptcy are very high, if that happens we will not recover anything, and we will not be able to cover any reparations. Spending that money was needed in order to be legally released from the contract with the contractors.
- Our hope is that with your support we can cover this fee, begin the urgent repairs, and not lose our home, regardless of the veredict.
- As of today, because of all the damages, the price of our house has devalued, and selling it would mean a big loss and not having enough to pay the bank.

THE BEGINNING
Challenges always take us by surprise, we never know when to expect them and how to face them because we have no control over the universe that sorrunds us. I have learned though, that if we have faith and we act with love, we are capable of finding the peace, strength and resilience that we need to overcome any obstacle. Faith and love, that’s what has been holding my husband and I together over the past 3 years since we became victims of a scam made by the contractor in charge of renovating our hous e .
The renovation was mandatory to be up to code with construction regulations in Belgium. It was supposed to be completed within 3 months, the reality is that 3 years have gone by and our house is still not finished.
It all started when my husband noticed discrepancies in the jobs "being done", we asked questions to make sure the work was being done accordingly. Instead of answers or trying to help us understand, the contractors gave us long, complicated answers until they finally left and never returned. After much insistence and trying to get a hold of them they kept deflecting our questions with a claim for more money in order to complete the work that we have already paid a big percentage for, and they have not even completed one single repair.
They took off and left us in chaos. Up to date the house has no floor nor doors. There is no kitchen, no heating and in the bathroom, we only have a toilet and running water but no sink or shower. All of this was paid to the contractors but never installed. We got scammed, they didn't finish any of the jobs and ran away with our money. Money that we got through a bank loan, which we have been paying ever since, alongside our house loan to be paid within the next 25 years.
SCAMMED AND ASKING FOR JUSTICE
We tried to solve it in a friendly way, trying to come to an agreement, but it didn't work.It was then when we decided to sue them. We knew it was going to be a tough, challenging and long road, but sueing them was the only way we had to legally break the contract and fix the house. From our own little corner we didn’t know what else to do, we were in debt and we had no way to fix our house, other than asking for justice for what we paid.
To our surprise, the path to justice has been slower and vastly more expensive than expected. On top of that, for legal purposes the house had to remain exactly as the contractors left it, so the ministry could validate the causes of the lawsuit. Without having the means to be able to afford another place to live or somewhere else to go, we have been living under these conditions since November 2017: without heating, bathroom, shower, kitchen, floors, etc. In February 2020 the judge released the construction site and we were given permission to start repairing again. Thanks to Katsumi's parents we were able to install the radiators (in July 2020) which we hope will be operational by November 2020.
IN DEBT AND THE PANDEMIC ARRIVAL
Having used all of our savings so far, we had no other option than to ask for another bank loan to repair the damages made to the house. We filled in the bank documents and then Covid-19 arrived. Not only everything stopped, I also lost my job because the lack of work within the enterprise. Because of that, at the beginning of August we got a call from the bank to let us know that our loan wasn’t approved,and on that same day we received a notification from the ministry of justice telling us that we have until the end of November to pay a 14,000 euro fee, without it we are not be able to schedule a date for trial in court.
In order for the judge to release the construction site (meaning being able to do repairs in our house again), first an official and neutrally legal report had to be issued with all the evidence to support the case in trial. This report was elaborated by an expert architect that was designated to our case by the ministry of justice, whose service fee is 9,000 euros. Plus 5,000 euros that need to be added for the issuance costs of the report and administrative charges.
A total of 14,000 euros that add up to many other expenses that we have been able to afford and move forward by using our savings and cutting off tight on our budget to make it possible to save little by little and pay for the lawyer, initial installments of the claim and required paperwork and procedures.
The deadline to cover the fee, combined with the current circumstances by Covid-19, leave us in a very tight spot, because if we don't pay it on time we risk losing our house if the ministry proceeds to seize it to cover this amount.
THE REAL STRUGGLE HAS BEEN EMOTIONAL
On that day, when we got the call from the bank and the notification from the ministry, we felt defeated but we were able to get up and realize it was time to ask for help. After all the time, money and effort that we have put in, we don't want to stop the lawsuit process now. It has been 3 years of constant struggle, a battle without rest, many sleepless nights, tearing apart dreams and shattering a home. Without a doubt, living under this circumstances has constantly challenged us.

The struggle has been present every day, during this whole time we have been using the showers at the local gym, inside the house we have experienced winters at -7 ° C (19°F) and summers over 40 ° C (104° F).
The most difficult thing has been the uncertainty of not knowing what will happen the next day and the risk of losing it all. When quarantine and the stay at home rule started, we felt anxious and scared just by thinking about staying 24/7 in a house that is not comfortable to live in. Nevertheless, this time has given us the opportunity and courage to reach out for help. All of this has been a real challenge, we have found some comfort doing what we enjoy, I (Katsumi) have discovered gardening and Jimmy practices martial arts. The real struggle has been a mental one. There is no photo or words that can make justice of what we face every single day.
THANKS TO YOU WE CAN START AGAIN
Despite all our efforts,despite the constant emotional and economic support from our parents,the situation has gotten out of our hands. That's why we are here, my husband and I, telling you our story, turning to you, to our family and friends. Because with your help we will be able to pay the last legal fees for the trial to happen and we can begin to move towards that almost forgotten dream , the one of our modest little house, where taking a shower and turning on the heat will give us the feeling of living in a forgotten luxury, things that we take for granted every day.
We are not making this funding to make up for the total amount of money lost, not even the legal expenses that we have already incurred. We just want once and for all, to finish the legal process, have a safe home and give an end to this bitter chapter in our lives, so we can start a new one. Every time that we close our eyes, we imagine this house as we have always dreamed of: full of light, peace, love and harmony, a little house in which all of you will be more than welcome one day.
If there is one thing we have to thank and recognize from this challenge, it is the great strength we have discovered in each other. Such a test can often ruin a relationship and a young marriage like ours, but it hasn't. Perhaps our physical house isn't a home yet, but our relationship has planted strong and unwavering roots, and what we are together as a couple, that is definitely our home, one that overflows with love, empathy and caring, full of strength and understanding.

WHERE ARE THE FUNDS GOING?
First of all we will pay the legal costs of

The other part of the funds raised will be used to finish the major renovations to be done at the house:
- € 5,200 - Fixing the electrical installation for it to be up to the belgian code
- €2,000 - Repair of the support beam
- € 3,200 - Re-do flat leaking roof over the bathroom and waterproofing
- € 2,800 - New installation of water pipes
- € 3,500 - Installation of a complete bathroom with shower
- € 4,300 - Installation of a kitchen that covers the minimum uses.
- € 3,000 - Installation of flooring for the first floor

EN RESUMEN:
- Después de una relación a distancia de 5 años, Katsumi (Mexicana) y yo (Jimmy, Belga) nos casamos en abril de 2017 y decidimos comprar una casa pequeña y modesta que sabíamos que necesitaría muchas reparaciones pero que con mucho esfuerzo, sería la casa de nuestros sueños, ideal para iniciar nuestra familia.
- Hace 3 años comenzamos la renovación necesaria para cumplir con la normativa en Bélgica. Ésta incluía reparaciones eléctricas, de plomería, aislamiento térmico, remoción de asbesto, etc.
- Al poco tiempo de iniciar , los contratistas nos estafaron, se fueron con nuestro dinero y nos dejaron más daños de los que inicialmente había que reparar.
- Demandamos a los contratistas en 2018 pues era la única opción que teniamos para terminar el contrato con ellos de una manera que no nos afectará legalmente a nosotros, a pesar de que ellos eran quienes habían incumplido.
- Ya hemos pasado la parte más complicada del proceso, el peritaje, pero necesitamos cubrir una última cuota para lograr llevarlos a juicio.
- Hemos usado todos nuestros ahorros para la demanda y seguimos pagando al banco por el préstamo que pedimos para la renovación y que los contratistas se robaron.
- Pedimos su ayuda para pagar la cuota legal de 14,000 euros y reparar los daños más urgentes que comprometen la seguridad de nuestra casa y nuestro bienestar ( ver detalles abajo en la sección “¿Qué haremos con los fondos recaudados?” )
- No podemos arriesgarnos a no pagar la cuota porque corremos el riesgo de perder nuestra casa ya que el gobierno puede tomar posesión de ella y subastarla para cobrarse lo que debemos al ministerio de justicia.
- Incluso si ganamos el caso, las probabilidades de que la compañía se declare en quiebra son muy altas, si eso pasa no recuperaremos nada, y no podremos cubrir ninguna reparación. Haber gastado ese dinero era una obligaciónpara poder ser liberados del contrato legalmente.
- Nuestra esperanza es que con su apoyo podamos cubrir esta cuota, empezar las reparaciones urgentes, y no perder nuestra casa, independientemente del veredicto.
- Al día de hoy, nuestra casa con todos los daños que le dejaron se devaluó, y venderla sería una pérdida y no alcanzaría para pagarle al banco.
Abrirnos y mostrar nuestra realidad no ha sido fácil, aceptar y pedir ayuda no es evidente. Tenemos fe en que el amor mueve montañas y confiamos en que lo que uno da, siempre regresa. Nuestro eterno agradecimiento por tu tiempo y por ayudarnos a reconstruir nuestro hogar.

EL PRINCIPIO
Todos encaramos momentos en la vida que nos desafían, nunca sabemos cuándo tocarán a nuestra puerta porque no tenemos control del universo que nos rodea. Pero he aprendido que si tenemos fe y actuamos con amor, encontraremos la paciencia, fortaleza y resiliencia para poder salir adelante. Fe y amor, eso es lo que nos ha mantenido de pie a mi esposo y a mí durante los últimos 3 años desde que fuimos víctimas de una estafa hecha por los contratistas a cargo de la renovación de nuestra casa.
La renovación era obligatoria para cumplir normativas legales en Bélgica, estaba programada para durar tres meses, la realidad es que han pasado ya 3 años y nuestra casa sigue sin poder estar lista.
Todo inició cuando mi esposo, Jimmy, empezó a notar inconsistencias en los trabajos que se estaban haciendo, cuestionamos a los contratistas, pero en lugar de darnos respuestas y ayudarnos a entender, se fueron de un día para otro. Tras mucho insistir y perseguirlos, solo se escudaban diciendo que necesitaban más dinero para regresar a trabajar sin siquiera haber completado ni una sola reparación y habiéndoseles pagado por adelantado un gran porcentaje del costo de la renovación.
Se fueron y nos dejaron en un caos. La casa hoy en día no tiene pisos ni puertas. No hay cocina, y en el baño sólo hay excusado, pero no hay lavabo ni regadera. Todo esto se pagó, pero jamás lo instalaron. Nos estafaron, no terminaron la renovación y se fueron con nuestro dinero. Dinero que obtuvimos a través de un préstamo bancario que mes con mes seguimos pagando, junto con el préstamo hipotecario que firmamos para poder pagar la casa a 25 años.
ESTAFADOS, TRATANDO DE PEDIR JUSTICIA
Intentamos resolverlo de una forma amigable, tratamos de llegar a un acuerdo con ellos, pero no funcionó. Decidimos entonces demandarlos ante la ley. Sabíamos que iba a ser un camino duro, desafiante y largo, pero demandarlos era la única forma legal para nosotros poder romper el contrato y reparar los daños. Desde nuestra trinchera no sabíamos qué más hacer, estábamos endeudados y no teníamos manera de arreglar nuestra casa más que pidiendo justicia por lo que pagamos.
Para nuestra sorpresa, el camino para hacer justicia ha sido más lento y muchísimo más costoso de lo esperado. Lo peor es que la casa tuvo que permanecer tal y como los contratistas la dejaron cuando abandonaron la obra para que el ministerio validara las causas de nuestra demanda. Sin tener manera de pagar otra vivienda ni tener otro lugar a dónde ir, hemos estado habitando la casa así como la dejaron desde 2017: sin calefacción, sin baño, sin regadera, sin cocina, sin pisos, etc. En febrero de este año (2020) el juez liberó la obra y nos dio luz verde para comenzar las reparaciones otra vez. G racias a los papás de Katsumi pudimos instalar los radiadores (Julio 2020) que esperamos ya puedan funcionar para Noviembre 2020.
ENDEUDADOS Y LA LLEGADA DE LA PANDEMIA
Habiendo utilizado todos nuestros ahorros nos vimos forzados a pedir otro préstamo al banco, para reparar los mayores daños hechos a la casa . Entregamos los documentos al banco y fue cuando empezó la pandemia. No solamente todo se paró, sino que también me quedé sin empleo debido a la falta de trabajo en la empresa. Por esta razón, en agosto de este año recibimos la llamada del banco para decirnos que el préstamo no fue aceptado y al mismo tiempo recibimos la notificación que tenemos hasta el último día de noviembre para pagar al Ministerio de Justicia una cuota de 14,000 euros sin la cual no se puede fijar una fecha en la corte para el juicio final.
Para que el juez pudiera liberar la obra, primero debía de emitirse un reporte oficial y legalmente neutro que recogiera toda la evidencia del caso. El reporte fue elaborado por un perito arquitecto que fue designado a nuestro caso por el Ministerio de Justicia, cuyos honorarios son de 9,000 Euros. A esto se le debe agregar 5,000 euros por la emisión del reporte final y cargos administrativos.
El plazo para cubrir la cuota, aunado a las circunstancias actuales por Covid-19, nos dejan en un aprieto muy grande, pues de no pagarla a tiempo nos arriesgamos a perder nuestra casa si el ministerio procede a incautarla para cubrir esta suma.
Todo lo que hemos avanzado es porque con mucho esfuerzo hemos podido sacar adelante las cuotas iniciales de la demanda, los honorarios del abogado y demás trámites ante la ley ahorrando poco a poco. Pero en este punto hemos agotado nuestros ahorros y nuestros recursos, es por esta razón que acudimos a este medio.
LA VERDADERA LUCHA HA SIDO EMOCIONAL
Llegó una prueba más al recibir en un mismo día la llamada del banco rechazando el préstamo, y la notificación del gobierno del pago de la cuota. En ese momento, sentimos que habíamos sido derrotados, pero pudimos levantarnos y darnos cuenta de que era el momento de pedir ayuda. Después de todo el tiempo, dinero y esfuerzo que hemos dedicado, no queremos detener el proceso de demanda. Ya van 3 años de una lucha constante, una lucha sin descanso, de muchos desvelos, arrebatos de sueños, y arrebato de un hogar. |
Sin duda este camino, este desafío de vivir en estas condiciones nos han puesto constantemente a prueba. La dificultad ha estado presente todos los días , y ha sido física y emocional . Durante todo este tiempo hemos utilizado el gimnasio local para tener acceso a regaderas, y dentro de la casa hemos pasado inviernos de -7°C y veranos de más de 40°C.
Lo más difícil ha sido la incertidumbre de no saber qué será del día siguiente y el riesgo de perderlo todo. Cuando empezó el confinamiento y la regla de quédate en casa, sentimos un miedo enorme porque teníamos que quedarnos 24/7 en una casa en la que no es muy cómodo vivir. Sin embargo, este tiempo nos ha dado valor para acercarnos a ustedes a pedir ayuda. Todo esto ha sido un gran desafío, hemos encontrado confort haciendo lo que nos gusta, yo he descubierto la jardinería y Jimmy no ha dejado de practicar artes marciales. La verdadera lucha ha sido emocional. Ninguna foto o palabra puede ilustrar esta situación en la que vivimos día con día.
GRACIAS A TI PODREMOS EMPEZAR DE NUEVO
A pesar de los grandes esfuerzos que hemos hecho, a pesar del constante apoyo emocional y económico de nuestros padres, la situación se ha salido de nuestras manos, por eso estamos aquí mi esposo y yo, contando nuestra historia, recurriendo a ustedes, a nuestra familia, amigos y conocidos. Porque con su ayuda podremos pagar los gastos administrativos del juicio y podremos empezar a encaminarnos hacia ese sueño casi olvidado que era el de nuestra modesta casita, sin lujos, pero habitable y segura para una nueva familia, en la que tomar una ducha y prender la calefacción nos hará sentir el lujo que verdaderamente son las cosas que antes habríamos dado por sentado todos los días.
No hacemos esta recaudación para recuperar el total del dinero perdido, ni siquiera los gastos legales en los que ya hemos incurrido, simplemente queremos dar término al proceso legal, tener un hogar habitable, poder darle fin a este capítulo tan amargo de nuestras vidas y empezar uno nuevo. La verdad es que cada que cerramos los ojos imaginamos esta casa tal y como siempre la hemos soñado: llena de luz, paz, amor y armonía, un hogar en el que todos ustedes serán más que bienvenidos algún día.
Si algo tenemos que agradecer y reconocer de este desafío, es la gran fuerza que hemos descubierto el uno en el otro. Una prueba así muchas veces puede arruinar una relación y un matrimonio joven como el nuestro, pero no ha sido así. A lo mejor nuestra casa física aún no es un hogar, pero nuestra relación ha sembrado raíces fuertes e inquebrantables, y lo que somos juntos como pareja, ese definitivamente es nuestro hogar, uno que desborda amor, empatía y cariño, lleno de fuerza y de comprensión.
