Founded in 1952, Palo Alto Little League creates a fun and enriching program for kids to experience sport, be part of an important local tradition, and develop lifelong lessons like teamwork, discipline, respect, and resilience. Our program impacts over 950 boys and girls ages 5-12 every year, including our underserved children with physical and mental disabilities.

We are an integral part of the Palo Alto community, and on any given day in the Spring you can see one of our teams playing and practicing on local fields, schools or our own property at Middlefield Ballpark. We have donated improvements at many of these fields in an effort to give back to the community that has supported us since 1952.

The funds from this raffle will support our short and long-term plans to offer an even better experience for our kids, coaches, umpires, families and community:

Modernize our fields and facilities, especially our 70-year old Middlefield Ballpark, to enhance practice opportunities, offer disabled access, increase fun for familiies, and create space for community building
Keep our equipment up-to-date for all divisions
Establish a training endowment to support our volunteer coaches, umpires and enhance baseball skills in our kids
Continue to contribute to the local Palo Alto community through enrichment programs and scholarships

Tickets will be sold through Sunday, October 15th and the drawing will take place on Sunday, October 29th.

Raffle reservations may be made on this website by the purchaser and the order processed by a PALL Little League Raffle Administrator. Internet and email entries will not be accepted.

Tickets are $75 each, 3-packs for $200, or 5-packs for $300. You may buy as many tickets as you like, but only 10,000 tickets will be sold for this campaign. Only one name will appear on each ticket. Please, no international orders or international credit cards.

OFFICIAL RAFFLE RULES

Little League of Palo Alto, Inc. (also known as Palo Alto Little League, and hereinafter referred to as “PALL”), a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting this PALL Tesla Raffle (the “Raffle”) pursuant to California Penal Code Section 320.5 to raise funds for ongoing charitable purposes. The rules and regulations of the Raffle are set forth below. By purchasing a Raffle ticket, the purchaser agrees to be bound by these rules and regulations. PALL’s interpretation and application of such rules and regulations shall be final.

The drawing for a Tesla Model S 75 (the “Prize”) will be held on Sunday, October 29, 2017. Tickets will not be sold after October 15, 2017. Tickets may sell out before that time. An independent raffle auditor will supervise the drawing. The winner does not need to be present at the drawing.

PALL will sell 10,000 Raffle tickets. Chances of winning are based on that number. If fewer than 2,300 Raffle tickets are sold by October 15, 2017, the Raffle winner shall receive a cash amount equal to one-half of the net proceeds from PALL’s sale of Raffle tickets (the “Alternative Cash Prize”), rather than the Prize.

The Internal Revenue Service (“IRS”) has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.

Upon transfer of the Prize title, the Raffle winner shall assume and pay all fees and costs (including, but not limited to, vehicle insurance and transfer tax and fees), as well as local, state and federal taxes (including, but not limited to, income taxes based on the value of the Prize). If the Raffle winner accepts the Alternative Cash Prize, he/she assumes all applicable federal, state and local taxes. PALL shall assume no responsibility for any tax liabilities in connection herewith. Please consult your tax advisor. This offer is void where prohibited by law, and all federal, state and local laws and regulations apply.

BY ENTERING THIS RAFFLE, EACH PARTICIPANT RELEASES PALL, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND CAUSED BY PARTICIPATING IN THE RAFFLE OR WINNING ANY PRIZE OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, AND THE WINNER AGREES TO INDEMNIFY AND HOLD PALL HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF PARTICIPATING IN THE RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE.

EACH PARTICIPANT HEREBY WAIVES THE PROVISIONS OF CIVIL CODE SECTION 1542 WHICH STATES THE FOLLOWING: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

TICKETS

Raffle ticket costs are $75 for one, $200 for 3-packs and $300 for 5-packs. Only one method of payment, one name, and one mailing address is permitted per ticket pack. For each ticket purchased, one eligible person may enter the Raffle. If more than one name is submitted with a ticket purchase, and that ticket is selected as the winning ticket, then the person first-named shall be deemed the holder of record of that ticket and declared the Raffle winner. Division of the Prize or the Alternative Cash Prize by a group purchasing a winning ticket in common shall be to the sole responsibility of the person named as the holder of record of that ticket.

PALL reserves the right to reject any entry form submitted with payment not constituting “good funds.” All defective or physically altered entry forms will be immediately disqualified by PALL. Prior to the Raffle drawing, PALL will make a reasonable effort to notify any individual or entity that submits such an entry form, or one that has been rejected due to credit card/check payment clearance failure or inability to contact such individual or entity through information provided with the purchase request. PALL assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the date of the Raffle drawing.

A RAFFLE PARTICIPANT'S SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH BY PALL SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR HIS OR HER RAFFLE TICKET(S). IN NO EVENT SHALL PALL, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO ANY PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

HOW TO PURCHASE

An individual or entity can purchase as many tickets as he/she or it may wish, subject to availability. Tickets cannot be purchased on the PALL Raffle website or by email. Raffle reservations may be made on the PALL Raffle website by the purchaser and the order shall be processed by PALL. All entries must include purchaser name, address, phone number, email address and a credit card number (including its security code and expiration date). PALL accepts payment only by credit card or PayPal. PALL reserves the right to reject any entry form that is submitted with payment that does not constitute "good funds." No refunds will be made by PALL, except for payments received in connection with ticket orders made after the sale of 10,000 Raffle tickets or after October 15, 2017. PALL assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the date of the Raffle drawing.

SELECTION OF WINNER

The drawing of all eligible Raffle tickets will be held on Sunday, October 29, 2017. The winner does not need to be present. The winner shall be notified according to the contact information provided to PALL at the time of the winning Raffle ticket purchase. If the winner cannot be located by 5:00 p.m. (PDT) on November 1, 2017, after PALL’s reasonable attempt to contact such winner through the information provided at the time of the winning Raffle ticket purchase, such winner shall be deemed to have elected the Alternative Cash Prize and another winner shall not be selected for the Prize or the Alternative Cash Prize.

The Raffle winner’s name will be posted on PALL’s Raffle website. In order to collect the Prize or the Alternative Cash Prize, the Raffle winner may be required to sign and deliver to PALL: (a) a sworn affidavit of eligibility in accordance with these rules and regulations and applicable law, including without limitation that he or she is at least 18 years old, (b) written information required by any applicable tax laws, including without limitation his or her social security number, (c) proof of identification satisfactory to PALL evidencing that the person claiming the Prize or Alternative Cash Prize is the same person named on the winning Raffle ticket, and (d) the winning Raffle ticket stub. The Raffle winner may be required to submit a W-2G, Form 5754 or similar tax forms (to be provided by PALL) for tax withholding purposes.

WINNING ODDS

Assuming a sale of 10,000 Raffle tickets, the probability of winning is approximately 1 in 10,000.

ELIGIBILITY

Any individual who is 18 years of age or older, and a U.S. resident physically residing in the United States, may enter the Raffle. PALL’s Board of Directors, authorized agents and employees thereof, consultants, attorneys, independent accountant firm, and their spouses and children living in the same household are excluded from participating in the Raffle. All federal, state and local laws and regulations apply. The Raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from the Raffle winner.

PRIZE

The Prize is a Tesla Model S 75. Alternatively and except as stated below, the Raffle winner may elect to receive a one-time cash payment of $80,000 (the “One-Time Cash Payment”). The Raffle winner must make an election in writing for the Prize or the One-Time Cash Payment by no later than 5:00 p.m. (PDT) on November 1, 2017. If the Raffle winner elects to receive the Prize, PALL will refer the Raffle winner to a local Tesla dealer for selection of vehicle features. If the Prize is not available due to circumstances beyond the control of PALL, as solely determined by PALL, the Raffle winner will be entitled only to the One-Time Cash Payment (except as stated below). A minimum of 2,300 Raffle tickets must be sold by October 15, 2017 in order for the Raffle winner to have an election for the Prize or the One-Time Cash Payment.

If fewer than 2,300 Raffle tickets are sold by October 15, 2017, the Raffle winner shall be entitled to the Alternative Cash Prize only, and shall not have an election for the Prize or the One-Time Cash Payment. The Alternative Cash prize will be 50% of the net proceeds of the Raffle. With respect to the Alternative Cash prize, the net proceeds of Raffle ticket sales will be determined by PALL and shall be final and conclusive. The net proceeds of Raffle ticket sales shall be calculated as the balance of funds after paying all Raffle expenses, including but not limited to, apportionment of gross proceeds as required by applicable law. If all Raffle tickets have been sold, PALL may, at its option, conduct the drawing earlier than October 29, 2017.

TERMS AND CONDITIONS

The Prize, if selected by the Raffle winner, will be transferred to the Raffle winner “AS IS, WHERE IS, AND WITH ALL FAULTS.” PALL DOES NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE PRIZE AND ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE MANUFACTURE OR CONDITION OF THE PRIZE. NO EXPRESS WARRANTIES ARE GIVEN AND NO AFFIRMATION OF PALL BY WORDS AND/OR ACTIONS WILL CONSTITUTE A WARRANTY.

All fees, applicable taxes and evidence of insurance will be due from the Raffle winner, upon transfer of the Prize title. If the Raffle winner accepts the Alternative Cash Prize or selects the One-Time Cash Payment instead of the Prize, all applicable and required federal and state taxes will be withheld by PALL in accordance with federal and state law, and PALL will remit the balance to the Raffle winner. PALL makes no guarantee that the Raffle winner will be able to sell the Prize for a particular value, nor that the IRS will accept that value of the Prize for the purpose of determining any income tax that may be due from the Raffle winner. PALL shall not be liable for any tax liabilities in connection with Raffle. Please consult with your tax advisor.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE RAFFLE SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA AND SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES AND UNDER ITS COMMERCIAL ARBITRATION RULES) SOLELY IN SANTA CLARA COUNTY, CALIFORNIA. ANY JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR SHALL BE ENTERED IN ANY COURT LOCATED IN SANTA CLARA COUNTY, CALIFORNIA AND SHALL BE CONCLUSIVE AND BINDING AND MAY BE ENFORCED IN ANY OTHER COURTS TO WHOSE JURISDICTION A RAFFLE PARTICIPANT MAY BE SUBJECT.
