Community Bike Works Spin-a-thon Release and Waiver of Liability

By registering for the Community Bike Works (CBW) Spin-a-thon event (event), I agree, warrant and covenant as follows:

In consideration of CBW’s acceptance of this event registration, I, undersigned, do hereby agree to release, indemnify and hold harmless CBW, all employees, officers and directors, all volunteers, all sponsors, officials, and their representatives, successors, and assigns from any and all injuries and/or death, damages (including but not limited to direct, indirect, incidental, special or consequential damages, including, for example, lost wages), liabilities, claims, costs and expenses and/or damage to or loss of property, whether or not arising from my own actions and/or inaction, the actions and/or inaction of third parties, and/or the actions and/or inaction of CBW arising from or in connection with my participating in this event.  I accept all risks associated with participation in this event including but not limited to sickness, injury, fall, effects of the weather, route conditions, or contact with non-participants or other participants.

I understand that: (a) BICYCLING ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH  (“Risks”): (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the event, the actions or inactions of others not participating in the event, the conditions in which the event takes place, or the negligence of others (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time, and I fully accept and assume all such risks and all responsibility for loss, costs, and damages I incur as a result of my participation or that of the minor in the event. By my participation in any event, I certify that I am aware of these inherent dangers of bicycle riding.

I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html.  I attest that if my community has a shelter in place order, that I will only participate in the virtual event by using a personal stationary bicycle, and I will not ride outside in the community during the duration of a shelter in place order.

I agree to follow the rules of the road applicable in my location for the use of bicycles, including, but not limited to, using an approved helmet when using a bicycle. (Not applicable to personal stationary bicycles.)

I accept and assume each and every risk of every and all nature, known, knowable, unknown, and/or unknowable, arising from my participation in this event, including, but not limited to, death, bodily injury, falls, contact with other participants, exercise-related injuries, equipment failures, and/or erroneous instructions and/or advice. I understand and acknowledge that there may be other risks, not articulated herein, associated with my participation in the event and I accept and assume those risks. 

I certify that, to my knowledge, there is no medical or other reason which would prevent me from safely participating in this event.  I warrant that I am in appropriate physical condition to engage in the physical activities which I seek to engage in at this event and that I have either been medically cleared, or waive the right to obtain medical clearance, for my participation in the physical activities which I seek to engage in at the event. I further warrant that CBW has advised me to obtain a physical examination from a medical physician before using any equipment and/or participating in the event.

I understand that my registration fee and all associated costs are non-refundable. I have read and understand that any photographs, videos, or other records of this event which may include my name, image or voice, become the property of CBW and may be used for any legitimate purpose, including but not limited to promotions benefiting CBW. I have read and fully understand the terms of this event registration, waiver and release. I understand that I am voluntarily giving up substantial rights by filling out this online registration, in whole or in part, and I intend the filling out of this online registration, in whole or in part, to be a complete and unconditional waiver and release of liability to the fullest extent allowed by the law. 

If I am registering third parties, I represent and warrant that I have been duly authorized to act as agent on behalf of such parties in performing this event registration. I agree to indemnify, defend and hold CBW and their respective officers, directors, employees and volunteers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or in connection with my participation in this event.  By completing this event registration, waiver and release, in whole or on part, I agree that the statutes and laws of the Commonwealth of Pennsylvania, without regard to the conflict of laws principles thereof, will apply to all matters relating to this event registration, waiver and release.  I agree that exclusive jurisdiction for any dispute with CBW with respect to this event registration, waiver and release resides in the courts of the State of Pennsylvania and I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Lehigh County, Commonwealth of Pennsylvania in connection with any such dispute If any provision of this event registration, waiver and release shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this event registration, waiver and release and shall not affect the validity and enforceability of any remaining provisions.  When registering a team or multiple participants in one transaction, all participants agree to the waiver.

I, the undersigned, am legally competent to sign this release. I have read the release, I understand its contents and I sign it voluntarily.

Minor Participant Waiver - Parent or Guardian will sign for the participant

**NOTE minors under the age of 13 are not eligible to participate in this event**

I am the parent and/or legal guardian of the registering participant, a minor and have the authority to act on behalf of the minor. I certify that, to my knowledge, there is no medical or other reason which would prevent me from safely participating in this event.  I warrant that the minor is in appropriate physical condition to engage in the physical activities which he/she seek to engage in at this event and that he/she have either been medically cleared, or waives the right to obtain medical clearance, for his/her participation in the physical activities which he/she seeks to engage in at the event. I do hereby agree to release, indemnify and hold harmless CBW, all employees, officers and directors, all volunteers, all sponsors, officials, and their representatives, successors, and assigns from any and all injuries and/or death, damages (including but not limited to direct, indirect, incidental, special or consequential damages, including, for example, lost wages), liabilities, claims, costs and expenses and/or damage to or loss of property, whether or not arising from the minor’s own actions and/or inaction, the actions and/or inaction of third parties, and/or the actions and/or inaction of CBW arising from or in connection with the minor participating in this event.

I grant Community Bike Works and/or its designates permission to use and/or publish any and all photographs and/or videos taken during the event.

I will require the participant named above to wear a helmet whenever riding a bicycle. (Not applicable to personal stationary bicycles.)
