I was released from state prison on May 7, 2020 after serving two years in prison to find my home still devastated. In addition to the damages done directly by 60 raiding police, my septic, well and associated water, sewage and electrical systems were out of order, my washer and dryer had died and countless items had been stolen by police and never reported on any police report or tabulation. My front door that had been bashed in by police was hanging on by a single screw and will not lock or function properly. My home security system had been partly stolen and partly smashed by the police in the raids.
While in prison, the court in Bay County Michigan was sucking on my "prisoner trust account" so hard it was drawing a vacuum in Jackson county! In my case the police called themselves the victim of my unstated crimes and I was forced to pay 400% of my prison wages ($84.00 per month) in court costs and restitution to the police "victims" making it near impossible to participate in the courts financially.
I am not complaining. I excel at a good challenge.
The challenge here is to stop Michigan from prosecuting people without stated criminal conduct and making it impossible for the alleged accused the ability to properly defend themselves against unstated charges.
Where a prosecutor does not state the laws you are being prosecuted for, the ability to defend is lost completely. Additionally, prosecutions upon unstated charges unlawfully relieves the prosecution of the duty and burden of proving the elements of the crime to the jury because their are no elements related to unstated crimes. In addition to that, people are not protected by Double Jeopardy laws and can be prosecuted more than once.
