Church of Women's Liberation hasn't added a story.
This project is a collaboration with Canadian lawyers and human rights advocates. We are launching a legal trust for court action to defend the rights of women and girls based on our sex.
Having a legal trust allows us to respond immediately when rights are violated. It increases our tactical options and levels the playing field against more powerful adversaries. It's a community fund and a war chest held in trust by a law firm for legal expenses only.
The directors are seeking lawyers
with expertise in human rights law and public interest litigation.
We are looking for a suitable test case with the potential to
challenge existing laws and policies that impact women and girls.
As advocates for Charter rights and freedoms, we support human rights for everyone in Canada. We are concerned about the growing conflict between gender identity and sex-based rights.
Sex refers to the biological realities of females and males, from reproductive health to bone density differences. Sex is fixed at conception and imprinted on every cell of the body. Gender identity is experienced by many as an internal feeling of being masculine, feminine, both, or neither, and may change over time. Both sex and gender identity are protected in the Canadian Human Rights Act.
New laws and policies are taking aim at what we say and think about gender identity, without sufficient regard for human rights based on our sex. New and pending legislation includes compelled speech and punishment for those who do not comply. These rules conflict with Charter rights pertaining to speech, belief, and association. The resulting harm disproportionately falls on women and girls.
A few examples of the conflict between sex-based rights and gender-identity rights:
- Convicted rapists and child molesters are self-identifying as women in order to move to women's prisons, where they have assaulted vulnerable women.
- The City of Vancouver canceled its annual grant to Canada's longest-running women's shelter after pressure from a handful of trans activists.
- Athletes who adopt a female identity are taking scholarships and awards from women and girls.
- Feminists have been demoted and fired for questioning gender identity.
We find that these
new gender identity policies do not respect the human rights and
dignity of women and girls. These actions expose a protected class
-- female persons -- to hatred and discrimination.
The good news is that this trend will not stand a proper
test in court. And more people every day are speaking out in
defense of sex-based rights.
Canada is obligated to uphold the inherent rights of female persons. But re-establishing this precedent will require collective action.
Finding the solution
Crucial aspects of gender identity legislation have not been tested or defined in Canadian courts. We are prepared to assist with court actions that have the potential to resolve questions about rights based on sex versus gender, such as:
- the right to single-sex spaces;
- the right to express reasonable beliefs about biological sex and gender without fear of retaliation;
- the question of children consenting to medical procedures that permanently change their reproductive and sexual function.

Our working group seeks supporters as well as legal professionals and women’s rights advocates to invest time, energy, and funds into taking back the ground we have lost.
We welcome referrals and suggestions for a law firm to host our legal trust. For now, funds raised are held in a dedicated account by our non-profit board of directors.
