Urgent; Judicial Review on July 12th
Unfortunately as predicted On Tower have been granted the licence. We were notified that our Appeal was unsuccessful on 24 May 2024.
This was very unfortunate and disappointing after putting in a lot of hard work, energy and effort. Between one thing and another it ended up not being necessary to proceed with the Injunction to prevent the Telecom company from erecting the mast during the Appeal process.
However we would like to thank those who made a contribution to the Appeal. It’s very much appreciated. That money is to hand.
We have been informed that we may well have a case for a Judicial Review. In order to establish that we would have to seek an opinion from a barrister who is very experienced in the area. As the deadline for the Judicial Review is July 10th, time is not on our side.
The bottom line is that we need urgent financial commitment from the community by Friday 21st June in order to give a sufficient amount of time to review the case, present an opinion and give the solicitor an opportunity to draft and lodge the Judicial Review before the deadline.
The Judicial Review will only proceed if it's felt there is a case.

History of our campaign.
The Rochestown Mast Action Residents (RMAR) are a group of concerned residents and parents who feel that it is imperative to prevent the erection of an 18-metre 5G mast in a residential area. This mast, if erected, could potentially end up servicing antennas for 3 providers, thus increasing both the height and the radiation levels. The proposed mast site is located in a residential area, close to the site of a new school (the building is in progress ) and a hospital. There is very good mobile phone and broadband coverage in the area, and there is no justification for an additional mast.
Some of our members are very aware of the consequences of man-made pulsed radiofrequency microwave radiation, often described as radiofrequency electromagnetic fields (RF/EMF), and the impact it can have on health, vitality and wellness due to their own personal experience of living close to existing masts.
In addition, it is now well documented how harmful the effects
of
cumulative exposure to this radiation
can be. The transmitter density required for increased
data transmissions for 4G and 5G will result in increased and
continuous high levels of pulsed RF microwave radiation for those
living nearby. This will, of course, result in even greater
health issues for those who are vulnerable, in addition to
increasing the risk of acute
symptoms and long-term illnesses
for everyone in the local area.
The RMAR lodged an Appeal to An Bord Pleanala in an attempt to halt the erection of the 5G mast in September '23. We recently discovered that the telecom company can legally proceed and erect the mast during the Appeal process, which makes it futile. We are now in a position where we have been advised that it will be necessary for us to take out an injunction in order to prevent the telecom company from proceeding with the erection of the 5G mast during the appeal process. This legal process would normally cost tens of thousands of euros; however, due to the support of a conscientious environmental lawyer/solicitor who is prepared to take on our case on a nominal cost basis, the cost of filing an injunction will be € 1,000. While this is a significant amount of money for any individual, we are hoping to spread the cost amongst many and are appealing to you for help keeping our community safe.
