Hello all,
My name is Mario Boisvert and I'm a serial entrepreneur from Montreal Canada. Every business I have been involved in over the course of my career has taught me something new. My current venture Groupe Bolema Inc. has been a big lesson about fighting for your business against the odds. It specializes in selling unique and healthy beverages, which bring customers both nutritional value and amazing taste.
Our story began in 2014 when, after twelve years of Research&Development, we have launched our first two products. SMART LIME is a lemon lime based drink containing the herb Ashwagandha and Ginseng whereas MACA SUTRA is a Maca root based, pineapple and coconut drink with natural libido enhancing qualities.
After the first official production run for Smart Lime, we received a legal document from Coca Cola telling us to immediately stop using the word "Smart" for our lime drink claiming that is a copyright infringement on their product called “Smartwater”. These two products have absolutely nothing in common, other than the word 'Smart' in their respective names.
This most absurd claim reminded me of a Groucho Marx letter I had read back in my college days. The letter was Mr. Marx's response to a legal letter he received from Warner Brothers ordering him to remove the name "Casablanca" from the title of his new movie "A Night in Casablanca". Mr. Marx's brilliantly witty and sarcastic letter inspired me to write something similar to the president of Coca Cola.

We're convinced that you would agree with me on the total absurdity of Coca Cola's claim and it's unscrupulous measures to simply intimidate and knock out the 'little guy'! They have already lost similar battles in Canada and in the UK while attempting to trademark a common word.
We see their attempts as an intimidation hoping to knock out the ‘little guy’ before he becomes too much of a competition.
The aim of this campaign is to raise money to keep us in business because we believe that it is not only the behemoths of the industry that have what it takes to offer value to the customer. Sometimes it is more likely that the small-unknown seller will do that with a lot more honesty and enthusiasm.

Voici l’état actuel des choses :
Après le premier cycle de production officielle pour Smart Lime et Maca Sutra, nous avons reçu un document juridique de Coca-Cola.
C’est donc, au Mois de Mai 2014 qu’une mise en demeure de la part de Coca-Cola Company et Energy Brand inc. fût produite à l’égard du Groupe Bolema. La raison : l’utilisation du mot «Smart ».
La SmartWater de Coca-Cola est une marque d’eau purifiée. Une eau qui se dit inspirée des nuages, contenant des électrolytes qui donnent un goût pur et rafraîchissant.
La Smart Lime du Groupe Bolema, est une limonade naturelle à base de jus de citron, de lime et d’extraits botaniques efficaces, contribuant à améliorer la mémoire et les facultés cognitives.
Mis à part le mot « Smart », ces deux produits distingués n’ont absolument rien en commun. Peut-être mise à part le fait que les deux soient liquides… Aucune ressemblance ne peut alors s’appliquer sur le logo, la typographie, le contenu, les couleurs.
Tout comme dans le passé, Coca-Cola poursuit des entreprises pour office de la propriété intellectuelle. Nous n’avons qu’à nous rappeler les poursuites intentées pour le mot « zéro » sur les marques autres que celle de Coca-Cola ou de Sprite. Qui aurait cru que zéro aurait autant de valeur ?
