Hi everyone. I appreciate all the help I've received so far and hate to ask for more, but some of you have mentioned that you'd like to continue helping with the case. That's why I've created this fundraiser for the $4500 trial retainer fee.

Due to the extensive preparation and time invested during a trial, my lawyer requires a $4500 trial retainer fee prior to entering his appearance. This is on top of the monthly expenses I've been racking up from other court dates.

Many of you know the basics of my situation already, but here's a brief rundown for those who don't:

In October 2018 the court approved a temporary order which changed my ex's visitation schedule from 30% custody to 6 supervised hours per week. This temporary order is still in place but was amended in March 2019.

My ex's custodial schedule increased to 12 supervised hours per week in March 2019, the same month he was placed on the state's child abuse registry for abusing our special-needs child. 

Ex has had at least 5 DFS hotline calls and 2 criminal investigations for child abuse during the last 7 months. The hotline calls came from mandated reporters, not myself or friends/family.

I filed a motion seeking sole legal and sole physical custody. My ex filed a motion requesting 50/50 custody. We are in a 50/50 state and previously had a 70/30 custody plan where I had 70% custody and my ex had 30%. However, my ex did not follow that plan for 5 years and chose to only come a few times a month. Our child(ren) began reported increased emotional and physical abuse after my ex unexpectedly began exercising his 30% custody after only visiting an average of 6 hours per week for 5 years. 

Ex claims he never abused the child(ren), so now we both have to take a court-ordered psych eval. We have both already paid for each other's evaluations, per the court's request, and the appointments are coming up soon.

My ex is in the process of appealing the child abuse registry listing, but he still has at least one open case for a separate incident of abuse. There is also still an active criminal investigation against him that is being reviewed by the local prosecuting attorney.  

I've spent around $20,000 on legal matters so far since the summer of 2018, and I continue to incur fees on nearly a daily basis. I have to pay my lawyer on a monthly basis, plus the kids' guardian ad litem and any services the court deems necessary. So far that's been a psych eval and coparenting counseling.

The court ordered that we each pay a $1500 retainer for the psych evals, and the psych eval office informed me that a retainer is exactly that: a retainer. Meaning expenses will likely exceed what I've already paid for the psych eval and may end up being $2500 to $5000, according to the office. I've been going to the counseling alone - which is $80 per individual session - and am unsure if my ex plans to attend in the future.  

We have court again tomorrow because my ex refuses to sign the consent form for our child's medical treatment even though I've agreed to provide all transportation, pay 100% of medical expenses, and only schedule appointments during my custodial time. Our child has several chronic medical conditions that require ongoing care.
