Noah uses AAC eye-gaze communication devices as his only way to communicate with those around him. He previously had the Tobbi I-15 and is currently using an AAC device called the WinSlate. All AAC devices come with a standard uniform and robotic voice. The child's boy voice that Noah uses is called "Josh." All children Noah's age that are boys sound like "Josh."
This poses a large problem for Noah when he's amongst other AAC users who are all using the same uniform synthetic robotic voice. Noah also doesn't perceive the sound of his AAC device as his own voice because it does not sound "human" but more like a "toy's voice."
Noah's treating providers and therapists recommended Noah obtain the VocaliD software for his AAC device to him more safety at home and in the community with his own individual crafted customized voice.
VocaliD would combine the donor voice of his little brother Luke along with Noah's natural vocalizations and blend them together to give Noah his own individual, unique voice that would most closely resemble what Noah would sound like if he were are verbally speaking child.
Noah's WinSlate device has a voicebox lanyard that Noah wears around his neck that would give him a greater sense of independence. Combined with the VocaliD software there would be no question that Noah's voice would be coming from him in everyway possible.
A Medicaid Waiver request was submitted in May fo 2016. While Noah's Medicaid Waiver through his Community Centered Board initially approved VocaliD, his request was then esclated to the State Department of Health Care Policy & Financing, where a three person panel created just for Noah reversed the approval and entered a denial.
An appeal was filed on Noah's behalf to take the matter before an Administrative Law Judge. The process was drawn out almost nearly a year due to the State Department's requests for court continuances and letter's indicating they needed more time to prepare their documents and evidence for Court. Ultimately, the case was heard January 9, 2017.
The Judge in the case came back with a decision February 3, 2017 indicating that he was not going to question the State's decision making for entering the denial and would not "second-guess under the circumstances of this case."
Now, Noah's only chance for his own voice to be heard is through the gift and help of others now that Medicaid and the AppellateCourt has failed in helping meet Noah's medically necessary and safety needs.
