We, my daughter and I are in desperate need of assistance to get back Miabella (5) and Hunter-Keldan (7). My grandchildren were taken by their birth father by way of falsified court papers. We are running out of time, there is only a certain time limit one can have an emergency custody order overturned. In order to get them back we need monetary help. We were informed we need to get an attorney in Virginia, our home state of 17 years, and we need an attorney in Texas, the state their birth father resides in. We also need monetary help in order to stay in Texas until the case can get moved back to the home state, Virginia. We have exhausted almost all of our funds getting to Texas and now staying in Texas. Please help us get them back home to us and their siblings!

        Here are the details leading up to and since they have been taken.

 

Tim and his girlfriend Pam traveled to Virginia, where we have resided for the main part of 17 years.

On June 26th 2019 Tim tried to force his way in to our home demanding the children be handed over to him. He had found us. When we refused, he yelled to his girlfriend Pam to run around the townhomes to get into the back door. He claimed he had custody but refused to show us the documentation while shoving his foot into door to keep it from closing. I with the help of their uncle shut the door on him and called the police after safely hiding all of the children upstairs. Police didn't press any charges and told him if he indeed has a court order from Texas to go file at the Virginia Court. The police advised us to file a protective order against him.

   The morning of June 27th we, my daughter and I went to the Virginia Beach courts to file the protective order against him.

On June 27th 2019

He returned to our neighborhood. Tim and his girlfriend Pam jumped out of the truck and grabbed Hunter-Keldan and Miabella from behind while they playing with their siblings, Toran (13), Sebastian (9), and several of their friends in front of their friend's townhome. While kicking and screaming for help they threw them into his truck all while they were being told "you are never going to see your family again". His girlfriend Pam saying "I am your new mommy now".

Their brother Sebastian tried to wrestle Hunter-Keldan and MiaBella out of their grip. He got thrown back and watched while his siblings were driven off. Toran jumped on his bike to chase after them.

  About 10 minutes after taking the children, police arrived and stopped him as he was leaving our area. He showed the police his custody papers. While they were reviewing the papers a warrant for his arrest comes through and he gets arrested. Charges being trespassing and disturbing of the peace. The police suggested for him to give the children back to us. He instead gives his girlfriend Pam the authority to take them. Which the Virginia Beach police officers allowed. The children barely know her. She drove off with the children to an unknown location.

  While in jail the protective order we filed was given to him. We never had the chance to go before the Virginia judge to get the kids back due to him bonding out before 8 am on June 28th. They fled the state with my children; presuming they took them to Texas.

On June 28th   

We went to the judge as soon as the court house opened with hopes of undoing what had just happened. He listened to my daughters’ story and told her "I know it wasn't in your plans for this weekend but you need to go to Texas immediately and file first thing Monday morning." The judge also advised her to get an attorney in Texas and an attorney here in Virginia and not to try this alone. "This is a complicated case and you will be railroaded if you do it without an attorney". He informed us to have the case transferred back to Virginia.

 

On June 29th,

we, my daughter, and I traveled straight through to Texas per the advice of the Virginia judge.

He was able to keep the children due to being awarded emergency custody via false allegations he filed at the courts in Galveston, Texas; where he currently resides. The allegations consist of lack of medical care, no education, amongst other things he threw on his never-ending list for the court. My daughter has years of records from doctors and schools proving his allegations to be false, but the damage was already done.

    At the Texas Court house after speaking with the district attorney we were told that a court appointed attorney had already been assigned to my daughter and that she had been trying to get in contact with her via email. Yet at the same time she was told that their system shows she wasn't served the court papers for the emergency custody hearing. Later it turns out the attorney is an Ad Litem and can't represent her.

 

    Four days after our arrival in Texas and six days after Tim took the children the court papers are delivered by the sheriff to our Virginia residence with the wrong address written on the papers even though the father of the children has known the correct address for several years.

 

    It has now been a month since the disappearance of Hunter-Keldan and MiaBella.

The first 2 weeks they have not been at his girlfriend's residence; the address written on the court documents. The Galveston police officers who did a 'Well Check' informed us stating 'it looks like nobody has been at that apartment for some time. My daughter drove by their apartment several times over those two weeks checking to see if her children were there.

 

     A couple days later another 'Well Check' was done by Galveston police dept. This time they happened to be there but we are certain they are living somewhere else. The police officer told us he can't disclose any information about their wellbeing, but said with a deep sigh 'They look alright on the outside' (meaning the are dressed, they are clean).

 

In February we allowed for Hunter-Keldan and MiaBella as well as their brother Sebastian to stay one night only trying to allow a decent relationship with their birth father. He refused to bring them back, but had his girlfriend drop off Sebastian saying “He only cares about keeping his”. We called Galveston police asking to get them back but they stated they cannot do anything without papers proving he has no rights to them. A few days later we were able to locate the Virginia court papers showing we had full custody of the children and he did not. Galveston police officers assisted us with returning the children. Galveston police didn’t allow us to press charges claiming he had rights to them and also claiming because we allowed him to keep them for a night then its "fine" if he kept them longer.

 

At that time there was no court order in place for visitation, because he had never officially acknowledged he is the father of the children nor did he want to put his name on their birth certificates. While they were with him, he hit them with the belt to wake them in the morning; hit them for crying. Forced them to sleep in the dark with the windows open, a completely strange place. His girlfriend pushed them down the stairs for walking to slow. He told Hunter-Keldan and MiaBella they had already ordered bunk beds for Pam's one-bedroom apartment. That Hunter-Keldan will be sleeping in one bunk with daddy and Miabella in the other bunk bed with Pam. They were told they will never see their mommy and their siblings again but could talk on the phone after things have calmed down. Sebastian told us about an incident where Tim threatened him with physical harm while there. Sebastian slammed the door shut, Tim's response was "if you slam the door again, I rip it off the hinges and push into your throat"

We are extremely concerned for Hunter-Keldan's and MiaBella's safety and their emotional and physical wellbeing.

The children's father has anger issues, a criminal history with several charges of assaulting a female not including my daughter because she never pressed charges out of fear. He has charges of 'assault with a deadly weapon' and other criminal charges. She left with the children because of his physical abuse, and emotional abuse. But she never once denied him visitation with the children in hopes of keeping his uncontrollable aggressive behavior to a low.

 

He also has 2 other children from two different relations. He doesn't want anything to do with his oldest child and has a permanent protective order against his second child after shooting up his ex’s house with her and their daughter in it after he lost the custody battle.

 

My daughter contacted a private attorney, who is experienced and successful with complicated cases like this one. After consulting with this attorney, she was told that the father of the children 'kidnapped' them regardless of the fact that he has a temporary emergency custody order in his hands; but snatching the children away with force against their will is considered kidnapping. A father with that kind of mindset, capable of doing what he did is dangerous and not safe to be around children.

He ripped her children, my grandchildren away from us, their siblings, Toran and Sebastian, their family and friends. He ripped them away from everything they have ever known.

 

I am desperate, I live in fear for Hunter-Keldan and MiaBella. We have very little financial resources and can't afford legal representation who is knowledgeable and experienced enough to handle interstate custody battles. We don't have the financial means to afford travel and lodging expenses while in this fight for my grandchildren.

I am appealing to you from my heart to please contribute to this fundraiser and share my campaign because I can't fight this fight alone. I have great hope and faith that with your donation we can win this fight for Hunter-Keldan and MiaBella to get them back to us and their family.

 

The contributions will strictly and carefully be used to cover attorney fees, travel and lodging expenses and I will continuously give you any new developments and updates.
