For those of you who did not follow the case, Derrick was charged with Murder 1, and sentenced to double life with no parole.
Now the reality of the trial is this: there was no forensic evidence introduced in the trial that implicated Derrick.
No DNA, blood, fingerprints, gunpowder, no weapons, he has an alibi witness that testified he was not present.
The money that he had in his possession was not identified as money that was involved in the crime.
The states own witness's testimony was disputed by the prosecutor after it was determined that he was not credible.
During deliberation by the jury, they asked the judge did they have to give everyone the same verdict and the judge stated that if you find one guilty, you have to find them all guilty.
His first attorney did not separate Derrrick from the other two men. In fact he did not see Derrick until two weeks before the trial.
During Derricks final appeal he sent Derrick a letter stating that he gave him ineffective counsel.
I am writing this because in recent months at least two cases have been appealed in Massachusetts due to the tactics that the police undertook to get statements from individuals. The same police/detectives were involved in Derrick's case. We could be real close to getting Derrick's case heard again with the appropiate attorney. But the reality is that they are expensive. We have exhausted our resources. The Attorney Rosemary Sachpiccio is very capable. But she does not work cheaply.
I asked Derrick, looking him into his eyes was he guilty of this crime. He looked me in my eyes and said no. I will tell you that Derrick has not been an angel, but he has never lied to me in his life.
