Timothy McClendon is a GOD fearing man, husband, father, son and brother. On September 25, 2011 GOD saved Timothy's life from a brutal attack where he was shot 6 times at close range. Timothy returned fire killing his attacker. Self defense right? Although Timothy survived the shooting his life was taken away from him when he was wrongly convicted of 1st degree murder and sentenced to life in prison.
On this day, September 25, 2011, Timothy went to the car wash on 43rd and Prospect as he normally does several times a week but today would be different. There was a gentleman there making money washing cars for people. As Timothy was waiting for this gentleman to finish washing his truck he had a seat on a concrete block talking on his phone unaware of the life changing events that were about to take place. The car wash has a camera system so everything is caught on video so we can see the attacker, Jose Jenkins, begin to stalk Timothy. First we see Mr.Jenkins ride past Timothy twice on Prospect before he is dropped of by his friend and accomplice Reggie. Reggie told the police that he knew Mr. Jenkins wanted to kill Timothy and that he was high on drugs and that he tried to talk him out of it but he continued to help Mr. Jenkins because he was scared of him and feared for his life. Although Reggie helped to carry out this plan he is NOT incarcerated. Mr Jenkins stood at the back of the car wash and watched Timothy for some time before being picked up again by Reggie and slowly riding past Timothy again. A few moments later Mr. Jenkins can be seen coming from the back of the car wash toward Timothy and when he is less than two feet away Mr. Jenkins opens fire on Timothy shooting him in the abdomen and extremities 6 times. Timothy trying to get away runs into the middle of busy Prospect Ave at the same time Mr. Jenkins opens fire on the gentleman that was washing Timothy's truck. With adrenaline pumping Timothy returns fire at Mr Jenkins who is running threw the car wash still shooting. In a state of shock at what just happened to him Timothy gets in his truck and drives to the back to look for the gentleman washing his truck thinking he may have been shot as well when he sees Mr Jenkins behind a trash can with gun still in hand. Timothy in fear of his life shoots Mr. Jenkins again. Mr Jenkins NEVER dropped his weapon. The gentleman washing the truck was nowhere to be found. Later when the gentleman was questioned by the police he thought that Timothy was dead.
Once at the hospital Timothy in pain and medicated was questioned by the police and when he requested an attorney he was denied. Timothy explained to detctives that he was defending hisself and they agreed. Less than 24 hrs after being shot 6 times Timothy was taken to headquarters and charged with 1st degree murder. Timothy has been wrongfully convicted of 1st degree murder and armed criminal action and was given life without parole plus 30 years for defending himself against a known criminal, drug dealer, and street thug. Timothy did not know or have any ties with Mr Jenkins and only GOD knows why he set out to kill Timothy but Mr Jenkins changed so many lives that day and Timothy and his family should not have to suffer any longer for the sin of another individual.
This defense fund is a life line for Timothy and every other American who finds themselves in a situation of an unjust justice system.
