Our goal is to Bring Don Tolliver Home. Don did not have a fair trial, a basic right of every American. Don is a single parent of five children who are now struggling with the fact that their parent is in prison for a crime he did not commit.
Don is a victim of a broken justice system, that is ruining our country like a plague on poor people. Prosecutors who hide evidence, tell untruths and break families,mentally and physically. We are a broken family that needs help. My name is Malissa Orns (Don is my brother) and I think the best way to describe Don, is with the testimony of his daughter Gabrielle who never got called to testify for him.. with her permission here it is.
1997-2000.
Dear Judge,
I am Donald Tolliver's daughter. I was subpoenaed for court but never got the chance to speak. I just wanted to give you a little history on my father and how truly great of a person he is or was.
From the beginning my Dad was my best friend. He met my mother in the year 1997. My mother was pregnant with her first child. She was not biologically my dad's but, my mom told my dad she was going to give the baby away, luckily my dad saved my sister's life. He stepped up and said he would be a father to the baby. He did not want to see a baby grow up without its father so he raised her as his own. My sister was born , a year and a half later I was born. My youngest sister was born the following year. In 2001 my father divorced my mother . She was cheating on him and hanging out with the druggy type pf people.
After this happened my Dad went to court and got full custody of me and my sister. He tried to get custody of my older sister , but she was not his , he tried his best and begged my mother to let us see her. She lives with us now because my grandmother wanted her to have a stable enviroment to live in and asked our mother for her.
2001
My mom and dad's divorce was final. My Dad moved to Jay and got help from my grandma ( I mean getting us up for school, baths and etc.) My Dad was working at Tyson's. He always worked to buy us what what we wanted and needed. I can actually say I had everything I wanted when I was little and I still thank him for that.
2002-2003
My dad met a woman where he was working at. And married her. She was nice to us up until after they got married. She got jealous of us girls so we went to live with our grandma that lived a few blocks away from my dad. My brothers was born, one in 2003 and one in 2004. I still came over to see my Dad and brothers and just ignored my step mom. Not only was she mean to us kids she was mean to my father.
2004
My dad lost a son. It was one of the biggest depressions I've ever seen my Dad go through. My Dad fell in love with something he never seen and cried over him everyday for about two years.
2005-2008
In 2007 my step mom discovered the internet. My Dad could not get her off the computer. She would just sit there. My dad would come home and have to cook and do all the house work. She charged my dad 60.00 a week to watch her own children. In 2008 my father bought me a guitar for my birthday I played it with him all the time. He bought a guitar for every child of his, thinking we could all become musicians someday.
2009-2011
The rough years for my Dad. He worked so much, he always had pnemonia. Tne winters was rough, but he worked every day. He was a boss, he had to be there. I remember actually watching my Dad's second marriage fall apart. He tried to leave numerous times but it never worked out as planned. Finally in 2010 my Dad said was leaving and getting away from my step mom for the final time. He took my oldest younger brother. She was so mad she pushed my brother out the door. My dad filed a police report. My Dad got custody of my two brothers.
The year 2011 he met a woman, started dating her, loved her. That is when the accident happened with this woman. She acussed my dad of hurting her, my dad has never laid a finger on a woman and I seen my dad go through two marriages without fighting with them. In three months, he hurt her. She has a past of fighting with her boyfriends. I fell into a deep depression because i felt my only parent left me. Its been almost 4 years now. I did not like going to the jail and probably will not go to the prison to see him. I think he is too good of a guy to be there. Everytime i see him i feel worse and I can't help it, I cry every single time. Since the accident happened I have not got to see my brothers. They was given to their mom. DHS in Missouri called and said that they was beaten so bad they removed them from their mom's home. They was put in foster care for a year and a half. My youngest sister has depression and anxiety and is taking medicine for it now.
My Dad and this woman was together for four months at the most. If I know my Dad the way I do. This should have never happened. I have never seen my Dad hit a woman in my life. And I believe this woman was fighting with my Dad. Just think about us kids that can't sleep at night knowing our Dad cannot be here with us.
Don was given 35 years for this woman getting a bandaid of her neck. They called it attempted murder. The prosecutor and the allegded victim in this case told a STORY word for word. Don and his children are the victims in this case. Like the case of Making a Murderer, Don was railroaded with many lies and evidence that did not get told at his trial. Don had a public defender that was overworked. His public defender called no one in Don's defense. Not one person. Please help us bring Don home.
We are planning on using any money we can collect to hire another lawyer , other than the one we have now ,and to use money for an investigator. I have done alot of investigating myself and have alot of new evidence to support Don's claims of innocence. We are planning on having a strong defense. This should have never happened to Don. Our family has rallied around Don and are supporting him 100%. WE believed in our justice system but it has failed us. Help us bring Don home.
