The Arizona Medical Marijuana Act ('AMMA') was passed by the Great citizens of Arizona in 2010. Within the AMMA is ARS § 36-2804.02(A)(3)(f) aka the "25 Mile Rule" which prohibits a qualifying patient and their designated caregiver from cultivating.
The Arizona Medical Marijuana Act ('AMMA') was passed by the Great citizens of Arizona in 2010. Within the AMMA is ARS § 36-2804.02(A)(3)(f) aka the "25 Mile Rule" which prohibits a qualifying patient and their designated caregiver from cultivating their own medicine if the patient lives within 25 miles of an operating dispensary. The 25 mile Rule clause violates Article 27, Section 2 of the Arizona Constitution which states, "To preserve the freedom of Arizonans to provide for their health care; A law or rule shall not compel, directly or indirectly, any person, employer or health care provider to participate in any health care system". We will be asking to court to declare the "25 Mile Rule" clause unconstitutional and asking for a injunction against its enforcement. Please join our Class Action suit by donating.
