My name is Brian James Pollard and I am from Cincinnati, Ohio and
I am 47 years old and single.
I am asking for financial assistance because my former employer
has refused my Americans with Disabilities Act (ADA) Reasonable
Accommodation Request for a shift modification and they forced me
into unpaid leave on 9/17/19.
I have taken medication for an endocrine condition for 47 years.
My doctors say the medication must be taken at the same time of day
and evening. If I fail to adhere to this schedule, my health could
be jeopardized and I could die.
My employer moved to a new shift schedule of 10 hours, 4 days a
week in mid-September 2019.
Since June 2016 I have been on an 8 hour day, 5 days a week and
my medication is taken at times to coincide with my work. I have
done very well at my job, being promoted to a Lead and worked as an
“Acting Supervisor”.
I am unable to do the new 4 x 10 schedule because of my
medication times, fatigue, rest that is needed and my immune system
is compromised from average people, due to the need to take steroids daily.
I have been unpaid since 9/17/19. Now I am told the employer
will not permit a modified shift and I am now fired as of
1/13/20.
The company has insisted I change my medication
schedule even though this could be
catastrophic to my health.
I am embarrassed and I find it humiliating to ask for
help. But my former employer's conduct has left me with no
other choice. I need money to survive --- food, rent, electric,
water and other small needs.
I would also save some of this money to use in legal
expenses to fight the injustices and treatment by this company
towards me.....a loyal and good worker who asked for a
shift modification that would cause the company no expense or
hardship as the legal definition states under the ADA.
I am also battling the health problems that the stress of this
situation has brought forth. The health problems involve a great
deal of anxiety that have caused negative consequences in my blood
work related to my endocrine disorder (CAH).
I hope nothing like this ever happens to you......but I am
standing up for injustice.......Will you assist and help prevent
this from happening to someone else......Maybe even you or a loved one!
