I am 34 years old I've been in prison since the age of 28. Im serving a sentence of life without parole for a crime I did not commit. I went to trial thinking the justice system was a fair thing, I was appointed a lawyer that should never of been a lawyer, and and is now banned. He's name is Javier Armengau, he is serving 13 years for sex crimes of rape on he's own clients and performing these acts while representing me. 

I have no family to help and that makes it hard to fight for my freedom, both of my parents and grandparents are deceased.  

Please read on and you will see the miscarriage of justice, that has been forced upon me and for that I'm paying the ultimate price my freedom!. After reading this you may have questions, feel free to ask anything, I can be contacted at jpay.com. Thank you for your time and consideration.

Let me start with my court appointed lawyer...

I was not informed that he was under investigation during the critical stages of my trial. How can someone be commiting sexual crimes against he's clients family? and still represent he's clients to he's fullest abilitie's? I would think he would be to worried about getting away with he's crimes to prepare for a murder trial. 

I asked the court to instruct my lawyer to hand over my discovery, and the judge who used to be my prosecutor told my lawyer he doesn't have to! I even tried to fire him and was told no. My lawyer refused to call any witnesses at my trial, I gave him a alibi witness and he never spoke to her. At every stage of my case I was a disadvantage, evidence was withheld from me til trial. I asked my lawyer for a private detective, and was told one would come to talk to me, then I found out one wasn't on my case! 

My lawyer informed me I had a winnable case, til I wanted to be involved with my case, from then on the only thing my lawyer did was try to get me to plea out. I was refused my right to aid in my own defense, I asked a question..if I was not allowed to see the evidence then how could I ever make a intelligent decision to proceed to trial? Even though I was going to trial to prove my innocence no matter what, I still had the right to see circumstantial evidence they had. 

My lawyer was involved in another case that has been under scrutiny for years, his name was Bobby Clarke and just so happens his procecutor was my judge. There is a private investigator named Ron Schererder who has ran a special on my judge/procecutor-lawyer in marion ohio, in a motion that the bar association filed to disbar my lawyer, they stated that my lawyer told a client he would sink like the titanic if he went to trial, he proceeded to trial representing himself and did not suffer the fate of the titanic he was found not guilty. That showed when my lawyer didn't like a client he didnt fight for them, I feel I'd of been better off with no lawyer.

There are many things that are wrong with my case, I will tell you a few...

I was charged with receiving stolen property of a car, that was the get away car. I was found not guilty by the judge on that charge. That being a essential element of my case, I ask how can I be guilty of murder? If I never drove that car.

I was charged with burglary. And after doing a search on my case, I found a motion that the state filed, that said my lawyer filed it. In this motion the state says there was no burglary. They have fixed the filing error now and it says there was no error, yet I was charged with burglary and a burglary charge was sent in front of the jurors. I was found guilty of burglary, the state them self's admit there was no burglary. 

After I was found guilty, there were 4 black hoodies took from my co-defendants house. The shooter had a black hoodie, why was them hoodies never tested for gun powder? The hoodie I had on tested negative for gun powder. 

One of the jurors went to school with the victim and did not divolge that info. 

There was a guy named Raymond morrow, who was in the same block as me in the county jail. One day, he was called to the grand jury to testify on my case, his lawyer was the same as mine. I called my lawyers secretary and told her I wanted him to step down from my case. After I was found guilty Mr. Morrow wrore me a letter, telling me that my lawyer told him to testify against me, and if he didn't know nothing to make something up! He said this happened on more then one accasion, I have a signed affidavit stating this. 

All the people who testified at my trial gave different stories in there first statements. A week later all there stories changed and matched each others. They lied in there 1st statements which is against the law, did they get charged for it? No. 

When the cops are out to get you, they will go to any length to get you, All witnesses got special treatment as far as charges. 

If for instance when cops question you, you have needle marks on your arms and you ain't say what they want you to say, you go to jail. Say what they want you to say, you go home, That is unfair. 

There were 4 guns testified about at trial, the guns were found behind a store,  and DID NOT have my DNA on them. One was a 38 cal 2 shot derranger, the murder weapon was a 38 cal gun. The 38 cal gun at trial was never seen by a gun expert before trial, therefor he would not exclude that weapon from being the murder weapon. If the state would of tested the gun I would have the answer, but because they didnt, all the jury thought that it was the murder weapon. None of the guns should of been allowed at my trial, they tested the DNA which came back not mine, nothing else was tested. 

 Witness testified to the state showing them key evidence in my case, that should of never even been showed to anybody til trial. It is clear that the state coached witness in my case. 

The cops told my co-defendant that he fit the description of the shooter, he had gun residue on him. He was arrested at the murder scene, he was seen on video at a certain time, so they said he could not be the shooter. 

At trial, it came out where my co- defendant was on video he left doing 70mph and the cops drove he's route at 25 mph and they ain't factor in his speeding, so they said he could not have done it. All adds up to him in the end.

The cop who was the lead detective on my case has told friends in the past, that he would get me one day where I could not get out of it. Well, he got me by using he's power to make things up on me. Since I've been locked up, the cop has been charged with perjury. 

A eyewitness told a story to a friend of mine, when they was at a store, that he had to go because, he just seen the person who killed he's cousin. Yet, I'm locked up for the murder. 

Last but not least, the appeal lawyer I had that was working on my case is now a prosecutor. They knew if they let him keep working on my case, he would get me out. So they offered him a job and sold me out, I was let down again.

I have faith, there are good people who want to help a guy against the ropes so let's fight together. 

There's a lot of things wrong with the way I was treated, the justice I need will only come from people like you, people who are willing to help when someone needs you the most. 

Some days I wake up wondering if I will ever know what freedom is, and than there are days I know I will. I can't explain how it feels to not have a out date. 

I will say this, it is not a feeling that anybody should ever have to feel for being innocent. I used to have faith in the justice system til I was rail roaded and trapped. I chose to go to trial because I thought it was fair and justice would be served, til I was stuck with a lawyer who was committing sex crimes in he's free time, a judge who used to be my prosecutor. The witnesses in my case was threatened and scared, nobody's story was the same at trial they all told the cops something different. There was no evidence at all, everything was based on hearsay. 

It is just another cover up to protect the guilty and let them walk free. 

I had a life before all this, I was due to get married and was trying to have a child, that was ripped away by a corrupt system.

Without your help I'm fighting a losing battle. Legal fees are high. Most people have turned there back on me, I'm stuck just wishing for freedom. 

America has human rights right? I'm human I have rights also! I have a right for my voice to be heard and my innocence proved. 

I need help from America and behond to fulfil this need. 

Whatever amount you can spare will take me that much closer, to getting a lawyer who will fight for me.
