We are facing imminent foreclosure on our home due to a fraudulent owner-financing agreement. Ten years ago, we purchased this property through an owner-financed contract with the previous owners. A title search at the time of purchase revealed only an existing mortgage lien held by Peach Tree. We entered into a contract to purchase, which was filed with the county records. We provided a copy of this contract to Peach Tree at signing.
For ten years, we made consistent monthly payments of $1,000 directly to [Mortgage Company Name], believing we were paying off the existing mortgage. Unbeknownst to us, during this period, the sellers fraudulently obtained an additional $60,000 loan against the property from Peach Tree. They instructed the mortgage company to defer this loan to the end of our payment term.
Now, after fulfilling our contractual obligations and paying off the original mortgage, [Mortgage Company Name] is initiating foreclosure proceedings for the $60,000 loan illegally obtained by the sellers. This loan was secured without our knowledge or consent, and despite our contract being on file with the county and provided to the mortgage company.
We are in a dire situation. We have exhausted our financial resources paying off the original mortgage and cannot afford legal representation to pursue a lawsuit. My inability to work due to a debilitating injury has resulted in severe damage to our credit, making it impossible to secure a loan.
We require $60,000 within one month to prevent foreclosure and save our home. We are victims of a predatory scheme orchestrated by the sellers and facilitated by [Mortgage Company Name], who disregarded our contractual rights and the recorded documentation.
Our immediate need is to save our home from foreclosure. However, our situation extends beyond that. Imagine living in a home that's become a danger to you. That's our reality. We are both disabled and struggle with mobility, and our stairs have become a constant threat. I recently fell three times in one month. We need to make our home safe with crucial modifications: safe porches, a downstairs bedroom and accessible bathroom, and a ramp.
Beyond that, we are living without working appliances. Our refrigerator and stove are broken, and our washer and dryer are failing. We are cooking on a hotplate. We are in a desperate situation. I have been waiting 18 months for disability, and my veteran spouse is also unable to work and fighting for his benefits. We are facing homelessness. We have no car. We are asking for your help to restore our safety and dignity.
