THE CROWN SEEKS TO SET ONE OF THE MOST DANGEROUS PRECEDENTS IN CANADIAN HISTORY
In January 2021 the government brought in lockdown regulations because of “C-19” and then later charged people criminally for violations of said regulations. The charge was ‘common nuisance.’
As an aside, many officers were against the idea of arresting people for peacefully protesting.
Fast forward two years later… anyone who received charges of common nuisance either had them stayed or dropped. Not one person in Canada had a trial… that is until I learned that Mr. McDonald had two separate trials scheduled for dates in November 2023. For whatever reason, they chose him as their test case.
As some of you already know, Mr. McDonald was found NOT GUILTY on January 3rd. The 1st judge agreed that our submissions reflected common sense. However, the judge presiding over the second trial, saw things differently and found Mr. McDonald guilty of common nuisance on January 16th, 2024… erring in both law and facts on multiple accounts.
Bottom line, Michael Lucifora (Crown) is determined to set a dangerous precedent that allows police to escalate bylaws into criminal charges through the guise of ‘for your safety’ or ‘the greater good’.
What does this all mean? Criminal charges could be applied to the climate change narrative, 15 minute cities or a new 'variant'… take your pick!
Whatever it is they're planning, Mr. McDonald’s case will no doubt have an impact (good or bad, depending on the outcome).
As of today, Mr. McDonald is fighting two appeals:
- The crown’s appeal to the NOT GUILTY verdict issued by Justice Richard Blouin on January 3, 2024
- Mr. McDonald’s appeal for the GUILTY verdict issued by Justice Joseph De Filippis on January 16th, 2024
Mr. McDonald needs $1480.75 for transcripts, required for appeal (invoice link https://drive.google.com/file/d/1qAaUQ_LMKUnV70jPoZpjxYolKk20mbJI/view?usp=sharing
We also need an estimated $8000 for legal research and consultation (20 hours of work from a selected lawyer) supporting to his legal arguments we’re preparing. Once all the paperwork is completed we will publicly post for all to see.
Mr. McDonald wishes to continue self representing on these appeals so that he can continue to run his own case. However, at this juncture he needs legal consultation and research because of the significance of these precedent setting appeals.
As these appeals progress we’ll be sure to keep everyone posted. Judicial history has shown that the courts act more reasonably when people are watching. Please share.
