This proposal asks for your assistance to crowdfund legal support to conduct a challenge to new California anti-gun laws enacted in 2016. (Those shown in bold font in the list below would be those which we would attempt to overturn in court.) Please donate today.
NOTE: As the deadline has passed for my own fundraising campaign, I am encouraging interested persons to donate via the FPC / FPF links provided below, which are the best ways currently to contribute to the legal effort to defeat anti-gun bills enacted in 2016. I am a member of FPC and support their efforts.
1) FPC (not tax-deductible)
https://www.firearmspolicy.org/blog/stop-ca-politicians-from-abusing-gun-rights/
2) FPF (if you donate here, it IS tax-deductible)
http://www.firearmsfoundation.org/gunpocalypse
If you donate at these above two links, the amounts you donate WILL be dedicated to helping overturn the recently enacted California gun laws (see list below) in court.
If you choose instead to donate directly to this fundrazr campaign, any money which is donated through this fundrazr campaign now or during the extended fundraising period, will be collected and used, if the amount is sufficient, to pay for the below activities with legal counsel.
A legal group has been identified which is willing to address this
issue. The questions I have asked that they would be answering
initially would be these:
1) What are the requirements and timeline for challenging these
laws in federal court (possibly under 42 USC § 1983) and and how long
do I (or anyone else for that matter) have to do so now that the bills
have been signed into law?
2) What is the process for developing a case such that various
people across the state could become involved as plaintiffs in a bill
of peace, a.k.a. class action lawsuit?
The initial cost to begin this process would require $2000. Costs beyond that would also be needed in order to continue any legal case. For that reason, a minimum of $2000 is needed, and $5000 minimum is sought through this particular campaign so as to successfully initiate any process of inquiry and launch any necessary legal collaboration. The purpose of this would be to identify suitable laws to challenge and how best to move forward.
From October 2013 through October 2014, 20 gun control bills in California that ended up getting signed into law by the Governor alone.
Incrementally, the approach of the Legislature is to introduce more bills, ensure that some or all of them will pass, and year after year gradually destroy Californian's ability to exercise the 2nd Amendment right.
Right now (2015-2016), the bills which have been passed by the
legislature and have been signed into law by the Governor (and thus
must be challenged in court) include:
AB 857 – The
Gutted and Amended Restriction On Curios, Relics and Home-Built
Firearms: Would require retroactive serialization and registration
of firearms from the past 50 years, including home-builts, as well
as curio and relics. (Has been signed into law by the Governor.)
Would create a precedent for registration that does not yet exist,
and needs to be challenged in the courts.
AB 1135 – The
Gutted and Amended “Assault Weapons” Ban: Part of a bill package
that would ban 70 percent of all firearms in CA.
(Has been signed into law by the Governor.)
AB 1511 – The
Gutted and Amended Bill that Criminalizes Loaning Firearms
(Has been signed into law by the Governor.)
AB 1695 – The
Bill Which Assumes Firearms Owners Are Guilty Until Proven Innocent
(Has been signed into law by the Governor.)
SB 880 –
Expands “Assault Weapons” Ban to Include “Bullet Button”
Semi-Auto Rifles, Pistols: Part of bill package that would ban 70
percent of all firearms in CA
(Has been signed into law by the Governor.)
SB 1446 – Ban
on ALL Magazines that were Designed to Hold More than 10 Rounds,
even those already legal under CA law (Has been signed into law by
the Governor) - Would create a precedent for ban on owning property.
SB 1235 (de
Leon) --Restrictions on ammunition purchases, creates a DOJ database
of ammunition owners. (Has been signed into law by
the Governor.) Would create a precedent for registration of
ammunition and unconstitutional restriction on commerce (violation
of Commerce Clause).
