When Luis A. López Soza’s 11-year-old daughter was asked to draw something she wished for, she drew a tent… Not because she wanted to go camping, but because her father is living without a stable home. She depends on him, and this situation has also affected her psychological well-being and is putting her education at risk.
Luis is a father, musician, and professional artist who sought asylum in the United States after fighting against a corrupt government in Nicaragua. He was kidnapped and beaten, and managed to escape to seek protection in the United States. He arrived with the hope of rebuilding his life and offering his daughter a safe future.
After falling in love with and marrying an American woman, he believed he was building a family and a shared life. Five years later, his world has fallen apart. According to Luis, after discovering his wife’s infidelity, she filed for divorce. They are currently separated, but remain legally married because the divorce has not yet been finalized.
While the legal proceedings move forward slowly, his wife maintains control of the home and the financial resources to which he lost access. Luis, meanwhile, is trying to survive and defend his rights without currently having an attorney for the divorce.
For more than two years, Luis worked in his wife’s company without receiving payment for his work. The company belonged to her, not to him. He also remained in Florida repairing the house after the hurricanes, dedicating time and effort to restoring the home while his wife controlled the money in the accounts.
According to Luis, she later blocked his access to all those accounts. This left him without the resources to support himself, help his daughter, and continue paying for legal representation. He also lost access to the phone line his wife controlled. Its suspension left him without a means of communication, making contact with his family and the court more difficult. At times, he depends on internet access provided by friends so he can respond to court communications and attend to his legal proceedings.
Luis had hired an attorney with the help of loans from friends and family. When he could no longer continue paying, the attorney withdrew. He now faces the divorce on his own, with limited knowledge of the judicial system and having to prepare documents and understand procedures in a language that is not his native language. His wife does have legal representation.
In addition, Luis disputes being held responsible for a tax debt of more than $320,000 that, according to him, belongs to his wife’s business. He states that his ITIN was used without his permission to file joint tax returns, without his authorization or signature, when he did not have a work permit or a Social Security number.
According to his account, it is being alleged in the divorce that these debts are marital debts to justify him receiving nothing in the distribution of marital assets. Luis has sent documentation to the IRS to request a review of these matters and of the responsibility others are seeking to assign to him.
This situation requires him to defend both his financial rights in the divorce and his position regarding a debt he does not recognize as his own. Without money to hire legal representation, it is very difficult for him to deal with matters of this complexity on his own.
According to Luis, the locks on the house were changed without a court order authorizing his exclusion. The judge did not grant exclusive use of the home to either party; both have the right to access it. However, Luis still has not received the keys and does not have effective access that would allow him to recover his belongings and have a stable place to sleep.
Luis explains that he was removed from the home through a domestic violence protection order based on false statements. That order was later dismissed. However, the difficulties in returning to the house and recovering his belongings have continued.
He also reports receiving threats of deportation through ICE if he did not sign documents giving up the house and his rights in the distribution of marital assets. According to him, the assets are in his wife’s name, and these threats have increased his fear and the pressure he feels while trying to defend his rights.
According to his account, his recording studio was destroyed and his instruments remain in the home. He also reports the destruction of his daughter’s room and her belongings, as well as the disappearance of many of his own possessions. Since June, he has not had access to his clothing and other personal belongings.
For a professional musician, losing access to his studio and instruments also means losing essential tools for developing his career and earning an income. Luis seeks to recover his belongings, document the damage, and resolve these matters through the legal process.
The situation has also affected his control over his artistic work. According to Luis, the intellectual property rights to his songs ended up in his wife’s name, and she blocked his access to the accounts and platforms through which he managed his music. This prevents him from controlling his songs and continuing to release new music, making it difficult to continue his work as an artist.
Luis also lost the car he used. According to his account, he had verbally agreed with his wife that the vehicle payments would be deducted from his salary for the work he performed in her company. He fully trusted that agreement, but states that the automatic payments were blocked and the bank eventually repossessed the car for nonpayment.
Although Luis asked for the vehicle to be in his name, according to him, his wife told him that this could not be done because he did not have papers. The car remained in her name, and its repossession by the bank left him without his own transportation, further complicating his ability to get around and attend to his needs and legal proceedings.
After months of struggle, Luis has spent nights on the street and has depended on friends and temporary accommodations for a place to sleep. He is alone and isolated in Florida, without stable housing and without the resources needed to consistently cover food, lodging, and transportation.
Luis has asked his wife and her attorney for compassion, explaining that he is living without a home and needs a solution. According to his account, his requests have been ignored and have not resulted in a solution that would allow him to stop living in these conditions.
To be able to eat, he sold the only guitar he had in his possession. He has been unable to access his other instruments because they remain in the home to which he still does not have effective access. Selling that guitar was a painful decision, but he needed to meet an immediate need: to feed himself.
The mental burden of everything he is experiencing has deeply affected Luis. The uncertainty, isolation, and nights without stable housing have harmed his psychological well-being. Living on the street, exposed to Florida’s high temperatures, has also affected his physical health. According to his account, his access to health insurance was also blocked, making it difficult to receive care when he needs it.
During this time, Luis was caring for his daughter’s pet, a one-year-old ferret that died on August 12 of this year. According to him, the animal became ill while they were facing high temperatures and a lack of stable housing. Without enough money to pay for veterinary care, Luis could not obtain the help needed to try to save it. This loss added more pain to a situation that was already very difficult for him and his daughter.
He also has two macaws that, according to him, are his emotional support animals and have supporting documentation. Both remain in the home, and Luis still cannot access them or regain their companionship. His parrots represent a very important emotional bond and a source of emotional support in his life. The separation causes him profound suffering, and he is also concerned about the birds’ well-being and how being separated from their human companion is affecting them.
Luis cries over his parrots and the helplessness of being unable to help his daughter as he did before. She depends on his financial support for school and her daily needs. The uncertainty and inability to receive the support her father used to provide have affected her psychologically. In addition, her education is at risk because Luis cannot pay for her school.
A girl’s education and well-being should not be jeopardized by conflicts between adults. The problems of the divorce must be resolved maturely, without making a daughter pay the consequences. Luis wants to regain the stability needed to support her, protect her education, and continue being there for her as a father.
Because Luis cannot return to Nicaragua, reuniting with his daughter requires bringing her to visit him. After years of work, he managed to make those visits possible and welcome her every year during the two weeks of vacation her school gave her. That time together allowed him to see her, hug her, and share moments with her that distance prevented them from experiencing during the rest of the year.
However, last year and so far this year, he has been unable to bring her. His daughter has asked him many times: “Daddy, when am I coming? I’m already on vacation.” Luis does not know how to respond without his heart breaking. He wants to hug her, but currently does not have the resources to pay for her trip from Nicaragua or a home in which to welcome her. If she came under these conditions, she would not have a safe place to stay either and would be on the street with him.
Added to the anguish of being unable to cover her schooling and her needs is the pain of being unable to give her that hug they are both waiting for. Regaining stable housing and the resources to reunite with his daughter also means regaining the opportunity to spend time with her and welcome her with the safety and affection she deserves.
Regaining that stability, reuniting with his animals, and being able to support his daughter again are needs deeply connected to his desire to recover his health and rebuild his life.
At the same time, he faces an immigration case to seek protection and avoid being deported to Nicaragua, where he fears for his safety because of what he experienced. The residency process based on his marriage was interrupted, and he now needs to continue with his asylum case. He currently does not have a valid work permit, which limits his ability to earn an income and rebuild his life.
Luis fears that his decisions could affect his legal and immigration proceedings. That uncertainty, combined with the lack of resources and a stable home, makes it even more difficult to find a way forward. He needs advice and representation to understand his options and defend his rights.
He is doing everything he can to move forward. He continues seeking help, attending to his proceedings, and trying to meet his basic needs. But facing a divorce and an immigration case at the same time, without access to the financial and material resources he once had, is a burden he cannot resolve alone.
Donations will help Luis A. López Soza obtain safe lodging, food, and transportation, support his daughter and her education, and cover the costs of legal representation for his divorce and immigration case.
The goal is for him to have a safe place to sleep, defend his rights, recover his belongings and the tools of his trade, regain control of his musical work, and rebuild the stability he and his daughter need.
What he is experiencing does not define the father, musician, or artist he is. Luis maintains his faith in God and the hope of reclaiming his life and supporting his daughter again.
Please donate or share to help Luis find stability and have the resources needed to defend his cases and move forward.
