As many of you know Ben found himself in a bit of trouble a few years back. He had been placed on pretrial services but violated due to doing invalid community service hours and an inability to pay the fines. They placed a warrant out for his arrest and when we found out we were expecting a new baby we relocated back to Florida and he turned himself in with hopes that this could be taken care of without having to miss any time with our new son. He was released RoR and never missed a court date. They ended up settling on probation which he has been faithfully adhering to for the better part of a year. On January 28 2015 he was arrested on an unjust accusation of child abuse and domestic violence causing him to violate his probation. On the day that he was arrested it was also found that there were 3 firearms in our home, registered to him, adding 3 more violations. After speaking with the state attorney in Hillsborough County about the events of that day they found no cause to move forward with filing the charges. Even though the charges were dropped they are still violating him on them, but there is a chance, with the right attorney, those violations can go away leaving just the firearms to be dealt with. Because of these violations the original case has been reopened, and that case carries a maximum sentence of five years in prison. I spoke with the attorney who represented Ben on the original case, normally he charges $2500 but since he was on this case previously, he said he would do it for 2000. I spoke with Ben and he asked me to reach out to his friends and family to see if anybody may be able to help him out in hiring this lawyer. After speaking with his public defender he and I both feel that he would stand much better chances being represented by somebody who has time to spend on this case, rather than somebody who will pick up his file as they walk into the courtroom. Having a private attorney can also speed up the judicial process leaving less time between court dates and to a quicker resolution. He has been in jail with no bond for nearing 2 months and Cyrus is growing so quickly, in this time going from a baby who could barely roll over to one who can crawl all over the place, sit up and pull himself up on furniture. We don't want to see him spend any more unnecessary time away. Any money collected will go directly to lawyers fees and court costs.
