*****Please see the updates section for the Water Protectors' Legal Collective's (WPLC) statement on the recent denial of the DAPL easement. There are currently over 500 potential criminal cases and many civil cases in North Dakota and WLPC desperately needs funds to defend the Water Protectors*****
Since April 2016, Water Protectors at the Standing Rock Indian Reservation have been defending against the construction of the Dakota Access Pipeline. The Pipeline would threaten local water supply by crossing the Missouri and Cannon Ball Rivers, which the Standing Rock Sioux Tribe and non-Native residents of North Dakota rely on for clean water.
As the construction of the Pipeline edges closer to their land, the Water Protectors have increasingly risked arrest in their resistance. Peaceful and unarmed Water Protectors, including Native youth and Elders, have stood firm against tear gas, rubber bullets, water cannons, sound cannons, and guard dogs. Along with this harassment, Water Protectors have been arrested and charged with various misdemeanor and felony charges.
The Water Protectors have the right, guaranteed to them by the First Amendment, to protest the contamination of their water. Within the legal profession, it is our duty to support them in their defense of clean water and a livable environment for all of us. Boalt Standing Rock Solidarity, a group of Berkeley Law students working to support the Water Protectors at Standing Rock, aims to raise $10,000 for the legal defense of the Protectors. We will be donating all money raised to The Water Protector Legal Collective fund. The Water Protector Legal Collective is coordinating civil and criminal legal services to all water protectors. Many current Boalt students have been remotely assisting the collective through a partnership with National Lawyer’s Guild.
If you are interested in getting involved in the legal support efforts, please email boaltsrs@gmail.com.
Along with legal assistance, the Water Protectors need supplies for surviving the North Dakota winter, and other forms of aid. If you do not wish to donate to the legal fund, please donate to camps and funds recognized by the Elder Council at Standing Rock – respecting indigenous sovereignty and leadership is an important part of supporting the Water Protectors. Below we have included a list of funds that are supporting indigenous-led camps:
