Cody Smith is a dedicated family man and was an equally dedicated second generation law enforcement officer with the Montgomery Police Department. But, sadly, his world was turned upside down when in the early morning hours of February 25, 2016, while patrolling a high crime area alone he was involved in an on-duty shooting following a stop-and-frisk. After Cody called for backup, the suspect failed to comply, fought off the officer and fled. As Cody continued to try and apprehend the suspect, he used all methods of non-lethal force to subdue the suspect before the suspect armed himself with a pole and the former Officer was left with only lethal force as an option to protect himself and the community he was policing. Unfortunately the suspect lost his life. As a result of this horrific incident, Cody was charged with Murder.
In November of 2019, Cody was acquitted of Murder but found guilty of the lesser charge of Manslaughter and in January of 2020 sentenced to 14 years in prison. His attorney, along with his family and friends, are fighting vigorously to defend Cody through the appeal process to prove his innocence and bring him home.
Cody and his family are in need of your financial support!! This has been a long and financially exhaustive process as you can imagine. With the loss of Cody's income, their resources have been depleted. His wife is now left to support their family while providing funds for Cody's defense.
Whatever amount, whether great or small, that you are able to give is very much appreciated!! Cody has remained strong in his Faith through this and knows that God has a plan and purpose for this incredibly difficult time in his life and he is immensely grateful for your prayers, support and generosity! At Cody’s sentencing he expressed his sincere condolences to the Gunn family for the loss of their loved one. This was never a hate crime as the media and prosecution portrayed. This was never an issue of a "bully with a badge". As his impeccable background reflects, he was a good man who loved his job as a police officer and was simply doing the job he loved when faced with a choice the brave men and women in uniform are faced with daily. If you have a loved one wearing the policeman uniform, we are convinced it could easily have been any of them as stated by so many other brothers and sisters in blue.
