Sara Jane is a child illegally removed from parents home and placed in child protective custody. Her Mother Misty was a victim of a domestic violence situation, where she was brutally beaten by the babies father. Sara, only 8 weeks old at the time was taken by CPS workers 2 weeks later, even though she was never harmed.
After being instructed to leave the home and ordered to file a 1year protective order against the father who was arrested at the time and charged with domestic battery and felonious assault.
Misty did as instructed and moved to a different county with the assurance by the CPS that nothing would happen to her or the child as long as she had a 16 week open CPS case in the county to which she moved.
The home to which she moved had to be approved by CPS and meet all their requirements. The case was transferred from one county to the other. Home inspection was passed and permanency established, along with several home visits from a case worker.
Two weeks after being established in another county and working with their providers, the previous counties CPS providers show up at her home and remove the child to place in foster care. They took the child to a foster home 2 hrs away from her mother. CPS stated that the child would be placed back with her mother within 3 months, It is now 17 months later and the mother is still fighting to get her back in the home.
The Mother has spent numerous hours taking classes and doing all kinds of stuff the CPS has ordered her to do. It all comes down to this, a child was taken from her mother because she was beat up by the childs father. All Of the above is supported with paperwork.
Legal Aid was no help and she now Needs a New Lawyer before November so she can keep her Child with her and Not in State Custody.
